Idle Animator Terms of Service
These terms are an agreement between you and Mild Beast Games LLC ("we", "us") about your use of Idle Animator (the "game") on iOS and Android. By tapping Agree in the game, or by playing it, you accept these terms. If you do not accept them, do not play the game.
The short version
- We let you play the game for your own enjoyment; we still own it.
- Fame and other in-game items have no cash value and cannot be exchanged for money.
- Your progress and purchases are stored only on your device. If you delete the game or lose the device, we cannot restore them.
- Refunds are handled by the App Store or Google Play.
Who can play
You must be at least 13 years old, or the age at which you can agree to these terms where you live. If you are under 18, you need a parent or guardian's permission to play and to make purchases, and they accept these terms on your behalf.
Your licence to play
We give you a personal, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial entertainment. The game is licensed to you, not sold. We and our licensors keep all rights in the game, including its code, art, animation, music, text and name.
You agree not to:
- copy, modify, sell, rent or redistribute the game or any part of it;
- reverse engineer or decompile the game, except where the law allows it regardless of these terms;
- cheat, or use hacks, bots or modified versions of the game, including to obtain Fame or purchases without paying for them;
- interfere with the game's ads, purchases or services.
Fame and in-game items
The game includes a virtual currency called Fame, along with cards, chests, boosts and other in-game items. You can earn them by playing, and you can buy Fame with real money.
- Fame and in-game items are a limited licence to use a feature of the game. They are not your property, have no cash value, and cannot be sold, transferred or exchanged for money, goods or anything outside the game.
- We may change what Fame and in-game items do, what they cost, and how they are earned, as we balance and update the game.
- Purchased Fame is delivered to the game on the device you bought it on and is used up as you spend it. It cannot be moved to another device or restored after the game is deleted.
Purchases and refunds
Purchases are processed by Apple's App Store or Google Play using the payment method on your store account, at the price shown at the time, including any taxes. All purchases are final except where the law or the store's own policy gives you a right to a refund. To ask for a refund, contact Apple or Google: they take the payment and decide refund requests, and we cannot issue refunds ourselves.
Ads
The game offers optional ads that you can choose to watch in exchange for a boost. Ads come from third parties, and we are not responsible for what they advertise. A reward may not be given if an ad is not available or is not watched to the end.
Your saved progress
The game has no accounts, and your progress, Fame and in-game items are saved only on your device. We do not keep a copy and cannot restore them. Deleting the game, clearing its data, or losing, resetting or replacing your device may permanently erase your progress and any unspent Fame, and we are not liable for that loss.
Changes to the game
We may update, change, suspend or stop offering the game, or any part of it, at any time. Updates may be needed to keep playing. We are not obliged to keep the game available or to support any particular device.
Privacy
Our Privacy Policy explains what information the game collects and the choices you have.
Ending these terms
You can stop at any time by deleting the game. Your licence ends automatically if you break these terms, and you must then stop playing and delete the game. The sections on ownership, Fame, disclaimers, liability and governing law continue to apply after the licence ends.
Disclaimers
The game is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the game will be uninterrupted, error-free or free of loss of progress. Some places do not allow these exclusions, so some of them may not apply to you.
Limit of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or progress, arising from your use of the game. Our total liability to you for any claim about the game is limited to the greater of the amount you paid us for purchases in the game in the six months before the claim, or USD 50. Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the law where you live.
Governing law
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in New Jersey, unless the consumer protection law where you live gives you the right to bring them in your local courts.
App Store terms
If you downloaded the game from Apple's App Store, these also apply:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the game and its content.
- Your licence is limited to use on Apple devices you own or control, as allowed by the App Store's usage rules.
- Apple has no obligation to provide maintenance or support for the game.
- If the game fails to meet a warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation.
- We, not Apple, are responsible for any claims about the game, including product liability, legal compliance, consumer protection and intellectual property claims.
- You confirm that you are not in a country under a US Government embargo and are not on a US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms as the game changes. The date at the top shows the latest version. If a change is significant, the game will ask you to agree to the updated terms. If you do not agree, stop playing.
General
If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a term, that does not mean we give it up. You may not transfer your rights under these terms; we may transfer ours to a successor of the game.
